Federal Judge Laura Taylor Swain will decide the fate of Power Expectations’ lawsuit against Puerto Rico’s electric utility, after the case was transferred to her court with her consent.
Power Expectations filed suit against PREPA on Sept. 2, seeking to reinstate the $5.887 billion temporary generation contract the two parties signed June 10, and asking the court to block any attempt to rebid the project. PREPA had asked federal Judge Raúl Arias-Marxuach to dismiss the case as “procedurally improper” or, alternatively, to transfer it to Swain’s court.
According to the case’s judicial record, the transfer to Swain was made with her consent. Swain already presides over PREPA’s broader Title III bankruptcy proceedings under the federal PROMESA law, which governs Puerto Rico’s fiscal oversight.
The transfer moves the case to Swain’s docket but does not resolve it — she has not ruled on whether the contract should be reinstated, and PREPA’s request to dismiss or halt case deadlines remains before the court.
